Pedestrian disfigured after dump truck hit her

Dumptruck

KINGWOOD -- A woman says she was permanently disfigured as a result of an incident that occurred when a Peterbuilt dump truck struck her as she was walking along the road.

Cindy Renee Bolyard filed suit July 10 in Preston Circuit Court against Hillside Trucking Inc. and Melvin C. Reckart.

Bolyard said she was injured July 12, 2012, as a pedestrian along W.Va. 7 when she was struck by a dump truck owned by Hillside Trucking and driven by Melvin C. Reckart. She says Reckart failed to stop the dump truck and provide aid, leaving the scene until another driver for the company informed Reckart they had seen him hit Bolyard.

Due to the defendants' negligence, she has suffered permanent disfigurement, loss of ability to enjoy life, diminished earning capacity as well as past, present and future medical expenses.

Bolyard seeks a judgment against the defendants in an amount that will compensate her for her injuries, with pre- and post-judgment interest, her attorney's fees, punitive damages and other relief from the court.

She is represented by attorney Virginia Jackson Hopkins of Kingwood.
