Raleigh Co. woman claims coal company damaged family cemetery

BECKLEY – A Raleigh County woman is suing over claims her property was damaged when a coal company unlawfully mined her property.

Connie Bailey filed a lawsuit Aug. 11 in Raleigh Circuit Court against Pocahontas Coal Company LLC and John Doe, citing negligence.

According to the complaint, the defendants' negligence in their surface mining and other activities on the plaintiff's property on Aug. 12, 2012, caused damage to her person and property, including an old family cemetery. Bailey says she did not give permission to the defendants to enter her property, and therefore the activities also constitute trespassing.

Bailey is seeking damages.

She is being represented in the case by attorney Joseph Mosko of McGraw Law Offices in Prosperity.
