Fayette Co. woman blames hospital for son's brain injury

BECKLEY – A Fayette County woman is suing over claims her son sustained permanent brain injury due to the nursing staff's negligence in his delivery.

Lisa L. Butcher, individually and as natural guardian of Jaron A. Butcher, an infant, filed a lawsuit Aug. 11 in Raleigh Circuit Court against Raleigh General Hospital LLC, citing negligence.

According to the complaint, Lisa Butcher gave birth to her son at Raleigh General Hospital on Aug. 16, 2013. Butcher says the nursing staff failed to recognize the non-reassuring fetal heart rate tracings and effectuate delivery in a timely manner, causing her son to suffer a permanent brain injury. The complaint states the child will never be capable of living independently and his medical condition has incurred medical expenses in the sum of $250,000.

The Butchers are seeking damages in excess of the minimum requirements of the court.

They are being represented in the case by attorneys Robert V. Berthold Jr. and Holly G. DiCocco of Berthold Law Firm PLLC in Charleston. The case has been assigned to Circuit Judge John A. Hutchison.
