BECKLEY – A Fayette County emergency medical technician is suing over claims she was injured in a collision on Interstate 64 in Virginia.
Annette L. Ellison filed a lawsuit July 11 in Raleigh Circuit Court against Jan-Care Ambulance Inc., Anna N. Lowry, General Ambulance Inc., CRST Malone Inc. and Don J. Daniels, citing negligence.
According to the complaint, Ellison was an emergency medical technician and a passenger in an ambulance owned Jan-Care and General and driven by Lowry on I-64 in Rockbridge County, Va., on July 18, 2012, when the ambulance was struck by a tractor trailer owned by CRST and operated by Daniels. Ellison says she sustained injuries to her leg, hip and back, and incurred medical expenses of more than $60,000.
The defendants are accused of negligence, willful, wanton and reckless conduct, and the plaintiff brings up the possibility the defendant ambulance companies knew of unsafe working conditions created by defendant Lowry's long hours assigned without appropriate time to rest.
Ellison is seeking compensatory and punitive damages. She is being represented in the case by attorney Anthony M. Salvatore of Hewitt & Salvatore in Fayetteville. The case has been assigned to Circuit Judge H. L. Kirkpatrick.
