BECKLEY -- A Fayette County woman is suing over claims a doctor failed to properly treat her after she fractured her wrist.
Rose and Dale Hayden filed a lawsuit July 14 in Raleigh Circuit Court against Barry Levin M.D. and Med-Surg Group Incorporated, citing medical malpractice.
According to the complaint, Rose Hayden presented to Raleigh General Hospital, where she came under the care of Levin, of Med-Surg Group, after she fell and suffered a severe fracture of her wrist on Jan. 17, 2012. Hayden says she underwent a closed reduction of the fracture by Levin on Jan. 18, 2012, as the doctor failed to discuss any other treatment options, but over the next few months, she continued to experience pain, numbness and other symptoms in her wrist.
The complaint states after numerous visits to Levin, Hayden finally went to West Virginia University Hospital on Oct. 10, 2012, where she was diagnosed with a carpel tunnel problem and shortening of the radius. Hayden says she underwent surgery called ulnar shortening osteotomy and carpel tunnel repair Nov. 14, 2012. The defendants are accused of medical malpractice in failing to discuss other treatment options with Hayden, specifically an open reduction of the fracture.
The Haydens are seeking compensatory and punitive damages, interest and costs.
They are being represented in the case by attorney David A. Ford in Charleston. The case has been assigned to Circuit Judge Robert A. Burnside.
