BECKLEY – A Raleigh County man is suing over claims the lower half of his body was paralyzed during kidney stone removal surgery.
Wayne Mills filed a lawsuit Aug. 1 in Raleigh Circuit Court against Raleigh General Hospital LLC, Mark D. Belcher M.D. and Lynnetta Faith Payne D.O., citing negligence.
According to the complaint, when Mills woke up from a kidney stone removal surgery performed by Payne, with Belcher acting as anesthesiologist, at Raleigh General Hospital on Dec. 17, he was unable to move his lower extremities. Mills says he is still paralyzed, and the defendants are accused of negligent care resulting in severe and traumatic injury to the plaintiff's spinal cord.
Mills is seeking compensatory damages, punitive damages and costs.
He is being represented in the case by attorneys Richard D. and Matthew C. Lindsay of Tabor, Lindsay and Associates in Charleston.
