Company hasn't paid for fuel, supplier claims

BECKLEY -- A West Virginia company is suing over claims another business has failed to pay for fuel provided on credit terms.

Bandy's Inc. filed a lawsuit Aug. 8 in Raleigh Circuit Court against Low Places LLC.

According to the complaint, Bandy's agreed to sell Low Places fuel on credit terms with payment due net 10 days, beginning with $6,008 worth of diesel issued Feb. 7. Bandy's says the defendant has failed to pay and collection attempts have failed.

The plaintiff is seeking the more than $6,000 owed plus interest and attorney's fees. It is being represented in the case by attorney James R. Sheatsley of Gorman, Sheatsley & Company LC in Beckley. The case has been assigned to Circuit Judge John A. Hutchison.
