Patient blames fall on Thomas Hospital

CHARLESTON – A Kanawha County woman is suing over claims she was injured in a fall while a patient at a hospital.

Hazel Ball filed a lawsuit Aug. 11 in Kanawha Circuit Court against Herbert J. Thomas Memorial Hospital Association, doing business as Thomas Memorial Hospital in South Charleston, citing negligence.

According to the complaint, Ball was a patient at the defendant hospital on May 28, 2013, when she suffered a fall and fractured her leg. The complaint states the hospital had recognized Ball was at risk for falls but was negligent and acted in willful, wanton and reckless disregard for her well-being in failing to provide her with adequate fall protection and safeguards.

Ball is being represented by attorney Charles M. Love IV of The Love Law Firm in Charleston. The case has been assigned to circuit judge Louis Bloom.

The case number is Kanawha Circuit Court Case 14-C-1426
