Couple says energy company damaged property

CHARLESTON – A Kanawha County couple is suing over claims an energy company damaged their property.

Daniel L. and Laura M. Bodkins filed a lawsuit Aug. 1, in Kanawha Circuit Court against Cunningham Energy of Charleston.

According to the complaint, Cunningham Energy began drilling on the plaintiff's 100-acre tract of land on Doctors Creek Road in Clendenin on March 1, 2013. The plaintiffs say Cunningham placed well sites and created roads so as to render 12 acres of land unusable, diminishing the value of the rest of the property.

The complaint also states Cunningham removed copper wire from the property, cut and took timber without permission and failed to place a gate across the road they created on the property as agreed.

The plaintiffs are being represented by attorney Clinton W. Smith in Charleston. The case has been assigned to circuit judge Jennifer Bailey.

The case number is Kanawha Circuit Court Case 14-C-1398
