FAYETTEVILLE – A Georgia company is suing over claims an auto sales and repair company has failed to pay for goods bought on credit.
NAPA Auto Parts/Genuine Parts Company of Atlanta filed a lawsuit Aug. 15 in Fayette Circuit Court against Wobo Used Motor Sales and Repairs Inc. of Oak Hill doing business as Wobo Motors Express Lube & Tires, citing breach of contract.
According to the complaint, the defendant submitted a credit application to the plaintiff on Oct. 27, 2011, and was provided with goods and materials accordingly. NAPA says Wobo has failed to pay, owing more than $5,200 plus interest. Wobo is accused of breach of contract or, alternatively, unjust enrichment.
NAPA is seeking the amount owed plus continually accruing interest.
It is being represented in the case by attorney John R. Keating of Amato, Keating & Lessa in Bethlehem, Pa. The case has been assigned to Circuit Judge John Hatcher Jr.
