Widow says communications tower responsible for pilot's crash, death

CHARLESTON – An Ohio County woman is suing over claims her husband was killed while operating an aircraft that collided with a negligently positioned communications tower.

Sharon Lee Lambert, as administrator of the estate of Richard Lee Lambert, filed a lawsuit July 21 in Kanawha Circuit Court against West Virginia Educational Broadcasting Authority, citing negligence.

According to the complaint, on June 22, 2012, Richard Lee Lambert was piloting an aircraft from Farmington, Pa, with a destination of Morgantown Municipal Airport when he struck a communications tower constructed by the defendant and suffered fatal injuries. The complaint states a fatal aircraft accident occurred nine years earlier involving the same communications tower, so the defendant has reason to believe the tower was a hazard to aircraft.

The defendant is accused of negligence in failing to maintain proper lighting on the tower in order to alert aircraft incoming to the nearby airport.

Lambert is represented by attorneys Scott S. Segal and Samuel A. Hrko of the Segal Law Firm in Charleston. The case has been assigned to Circuit Judge Tod J. Kaufman.
