Company says contractor didn't pay for rental equipment

SUMMERSVILLE – An equipment company is suing over claims a construction company has failed to pay for rented equipment.

B.E.T. doing business as Bridgeport Equipment and Tool, filed a lawsuit Aug. 18 in Nicholas Circuit Court against Norco Construction Company Inc. of Summersville, and Charles L. Comer Jr., citing breach of contract.

According to the complaint, Norco contracted B.E.T. for equipment rental and repairs Aug. 20, 2013, but has failed to pay the full sum owed. B.E.T. says, as of July 14, Norco owed more than $5,800 plus interest. Norco is accused of breach of contract and unjust enrichment. Comer, who contracted to be personally responsible for Norco's debts, is accused of breach of guaranty.

B.E.T. is seeking more than $50,000 in damages. It is represented by attorney Gerald Edward Lofstead III of Spilman Thomas & Battle in Wheeling. The case has been assigned to Circuit Judge Gary L. Johnson.
