BECKLEY – A Fayette County man is suing over claims his former doctor mailed his medical records to a stranger.
D.H. filed a lawsuit Aug. 25 in Raleigh Circuit Court against Iraj Derakhshan, M.D., and Comprehensive Neurology Inc., citing negligence.
According to the complaint, in July 2013, Derakhshan's practice, Comprehensive Neurology, informed its patients, including the plaintiff, that the Beckley office would be closing and making patient records available. D.H. says he signed the release forms on July 29, 2013, and later learned that on Sept. 11, 2013, an unknown third party received his records in the mail.
The complaint states the third-party contacted the defendants who told her to shred the records without informing the plaintiff and instead sent records to D.H. on Sept. 18, 2013.
D.H. says he has suffered stress and concern, not knowing to what extent his private medical records have been revealed to unknown parties. The defendants are accused of negligence, gross negligence, intentional or reckless infliction of emotional distress, negligent hiring and/or retention, training and/or supervision, negligent entrustment and breach of confidentiality.
D.H. is being represented in the case by attorney Steven B. Wiley in Norfolk, Va.
