McDowell Co. man says he was fired for filing workers' comp claim

PINEVILLE – A McDowell County man is suing over claims he was fired for filing a workers' compensation claim.

Matthew L. Mullins filed a lawsuit Sept. 17 in Wyoming Circuit Court against Carter Machinery Company Inc., citing workers' compensation discrimination.

According to the complaint, Mullins was employed by the defendant company at its Pineville location from April 10, 2010, until he was injured on the job and filed for workers' compensation. Mullins said it was ruled compensable, but on Nov. 4, 2013, he was fired. The defendant is accused of discriminating against and firing Mullins due to his compensation claim.

Mullins is seeking damages, rehiring or front pay, back pay and attorneys' fees. He is being represented in the case by attorneys J. Michael Ranson and Cynthia M. Ranson of Ranson Law Offices in Charleston and G. Patrick Jacobs of Jacobs Law Offices in Charleston. The case has been assigned to Circuit Judge Warren R. McGraw.
