Woman says husband was victim of fatal neglect at nursing home

CHARLESTON – A Kanawha County woman is suing over claims her husband suffered fatal neglect in a nursing home.

Shirley Bragg, as personal representative of the estate of Thomas Bragg, deceased, filed a lawsuit Aug. 26 in Kanawha Circuit Court against Fayette Nursing and Rehabilitation Center LLC, doing business as Fayette Nursing and Rehabilitation Center, and Wisteria LLC, citing wrongful death.

According to the complaint, Thomas Bragg was a resident of the defendant companies' facility Fayette Nursing from September 2010 until Jan. 1, 2013, during which time he suffered neglect, including skin breakdown that the defendants failed to prevent and then failed to treat, which ultimately contributed to his death. The defendants are accused of statutory violations, negligence, ordinary negligence and reckless misconduct, and wrongful death.

Shirley Bragg is seeking damages and attorneys' fees.

She is being represented in the case by attorneys Andrew L. Paternostro, Sprague W. Hazard and Jeff D. Stewart of The Bell Law Firm PLLC in Charleston. The case has been assigned to Circuit Judge Tod J. Kaufman.
