Man says he was injured in Kroger restroom

CHARLESTON – A Kanawha County man is suing over claims he was injured in the restroom of a Kroger store.

Brian Caldwell filed a lawsuit Sept. 2 in Kanawha County Circuit Court against The Kroger Co., citing negligence.

According to the complaint, Caldwell was shopping at the defendant's store on MacCorkle Avenue, Southeast, in Charleston on Dec. 3, 2012, when he slipped on water on the floor of the men's bathroom and sustained injuries to his back and right hip. The defendant is accused of negligence in failing to maintain the premises.

Caldwell is seeking damages, medical expenses, interest and attorneys' fees.

He is being represented in the case by attorney Shawn R. Romano of Romano and Associates PLLC in Charleston. The case has been assigned to Circuit Judge Louis H. "Duke" Bloom.
