Company says Winfield installed sidewalks without acquiring property

WINFIELD – A Putnam County company is suing over claims the town of Winfield built sidewalks on its property without acquiring it.

CV Management LLC filed a lawsuit Sept. 19 in Putnam Circuit Court against the Town of Winfield, citing unconstitutional taking.

According to the complaint, the Town of Winfield installed new sidewalks along West Virginia 817 in 2013 without verifying that it was in the West Virginia Department of Transportation's right-of-way and failing to first acquire the plaintiff's property and that of its neighbors. The complaint states this makes the action unconstitutional taking.

CV Management is seeking the fair market value of its property, the difference between the fair market value of its adjacent property before and after the taking, costs of remedial measures such as relocating a sign, and attorneys' fees.

It is being represented in the case by attorney Ancil G. Ramey of Steptoe & Johnson PLLC in Huntington. The case has been assigned to Circuit Judge Joseph Reeder.
