State sues Va. firm after wreck damaged I-79 overpass

CHARLESTON – The West Virginia Division of Highways is suing over claims a commercial truck struck and damaged an overpass.

Paul A. Mattox Jr., commissioner, and the West Virginia Department of Transportation, Division of Highways, filed a lawsuit Sept. 15 in Kanawha Circuit Court against EMATS Inc. of Cedar Bluff, Va., citing negligence.

According to the complaint, an EMATS tractor trailer hauling a wood chipper was traveling eastbound on West Virginia Route 33, commonly known as Bunner's Ridge Road, in Marion County, on Oct. 25, 2012, when the vehicle struck the Interstate Highway 79 overpass, causing extensive damage to the structure of the overpass and requiring the Department of Transportation to spend more than $500,000 repairing it. The defendant is accused of negligence.

The plaintiffs seek more than $500,000 in damages.

They are represented by attorney C. Brian Matko of the West Virginia Department of Transportation, Division of Highways, legal division.
