WHEELING – An Ohio company is suing over claims it hasn't been paid for barge repairs and rental.
Bellaire Harbor Service filed a lawsuit Oct. 1 in federal court against GraeStone Logistics of Murray, Ky., and Four Rivers Towing of Paducah, Ky., citing breach of contract.
According to the complaint, Bellaire Harbor Service leased the merchant vessel M/V Russell T to Four Rivers Towing via a barge charter Nov. 7, 2012, but when the Russel T was returned in June 2013, one of its generators was damaged. Bellaire says when it submitted an invoice for the repairs per the barge charter, Four Rivers failed to pay, and owes more than $111,600.

According to the complaint, in June 2013, GraeStone delivered a barge to Bellaire's fleet for repairs. Bellaire says it performed fleeting and pumping services, but GraeStone has failed to pay the $72,900 owed.
The complaint states GraeStone also delivered tank barge to Bellaire's facility on the Ohio River for repairs in August 2013, and owes more than $15,400 for repairs performed on that barge. GraeStone Logistics is accused of breach of contract and unjust enrichment.
Bellaire Harbor Services seeks the amounts owed plus the forfeiture of GraeStone's property, the merchant vessel the M/V J. W. Herron.
