Tenn. man says he was injured in hotel shower

CHARLESTON – A Tennessee man is suing over claims he was injured in a hotel shower.

Frank W. and Diane Chapman filed a lawsuit Sept. 11 in Kanawha Circuit Court against Silver Creek Charleston A, doing business as Fairfield Inn by Marriott, and Southwest Hospitality Management, citing negligence.

According to the complaint, Frank Chapman was a guest of Fairfield Inn on Washington Street in Charleston, owned by Silver Creek and operated by Southwest, on Nov. 30, 2012, when he took a shower in his room's bathroom, grabbed the safety bar near the bathtub and the bar detached from the wall, causing him to fall.

Chapman says he sustained injuries to his neck, both shoulders, his knee, both hips and ankle.

The defendants are accused of negligence, and Diane Chapman is suing for loss of consortium.

The Chapmans seek compensatory damages, interest and costs of court.

They are represented by attorneys Sean P. McGinley of DiTrapano, Barrett, Dipiero, McGinley & Simmons in Charleston, and Beecher A. Bartlett Jr. of Kramer Rayson in Knoxville, Tennessee. The case has been assigned to Circuit Judge Louis H. "Duke" Bloom.
