HUNTINGTON – A Maryland woman is suing over claims she was injured when she fell in a pothole while visiting her daughter in Huntington.
Denise DeMicco filed a lawsuit Sept. 16 in Cabell Circuit Court against American Campus Communities Services Inc., doing business as Village on Sixth Avenue, citing premises liability.
According to the complaint, DeMicco was walking in the parking lot of a Speedway station on the defendants' premises at Sixth Avenue and 20th Street in Huntington while visiting her daughter, a Marshall University student, on Sept. 16, 2012, when she fell in a pothole and sustained injuries.
The defendant is accused of negligence and premises liability.
DeMicco seeks general and punitive damages, back and front pay, interest and attorney fees.
She is represented by attorney Abraham Julian Saad of Saad Law Office in Huntington. The case has been assigned to Circuit Judge Christopher D. Chiles.
