Putnam woman says ER should have performed MRI

HUNTINGTON – A Putnam County woman is suing over claims she was negligently discharged from an emergency room and sustained injuries.

Elizabeth Willard Bird and Brian M. Bird filed a lawsuit Sept. 17 in Cabell Circuit Court against River Valley Emergency Physicians Inc., citing negligence.

According to the complaint, Elizabeth Bird entered River Valley Emergency Physicians in Huntington on Jan. 20, 2013, with complaints of numbness in the perineal area and other worrying symptoms, but the defendant negligently discharged Bird without ordering an MRI.

As a result, the complaint states, Bird sustained serious injuries. The defendants are accused of negligence and deviated from the accepted standard of care. Brian Bird is suing for loss of consortium.

The Birds seek compensatory damages and fees.

They are represented by attorneys William Samuel Druckman and Madonna C. Estep of the Law Offices of Druckman and Estep in Charleston. The case has been assigned to Circuit Judge Christopher D. Chiles.
