Mason Co. man blames 7-Eleven for fall in icy parking lot

CHARLESTON – A Mason County man is suing over claims he was injured in the icy parking lot of a gas station.

Joseph and Kathy Milanese filed a lawsuit Sept. 23 in Kanawha Circuit Court against 7-Eleven Inc., citing negligence.

According to the complaint, Joseph Milanese was at the 7-Eleven on Lens Creek Road in Hernshaw on March 5, when he slipped on ice and snow that had accumulated in the parking lot and fell, sustaining injuries including a displaced femoral neck fracture. The defendant is accused of negligence in failing to maintain the premises and provide adequate lighting.

Kathy Milanese is suing for the loss of the society of her husband.

The Milaneses are seeking damages, interest, and costs of court.

They are represented by attorney Paul E. Biser of Fredeking and Fredeking Law Offices in Huntington. The case has been assigned to Circuit Judge James C. Stucky.
