Maintenance man says he wasn't paid all wages

CHARLESTON – A Kanawha County man is suing over claims he was not paid all wages owed him after his termination.

David Beach filed a lawsuit Oct. 8 in Kanawha Circuit Court against St. Albans Properties LLC, citing the Wage Payment and Collection Act.

According to the complaint, Beach was employed as a maintenance man at the defendant's facility on Highland Drive in St. Albans from December 2013 until June 3, when he was terminated due to his inability to appear for work. Beach says the defendant failed to pay all wages due to him, constituting a violation of the Wage Payment and Collection Act.

Beach is seeking damages, interest and attorneys' fees.

He is being represented in the case by attorney Kevin A. Nelson of Huddleston Bolen LLP in Charleston. The case has been assigned to Circuit Judge Tod J. Kaufman.
