Medical facility says doctor not making payments for office

CHARLESTON – A Kanawha County medical office is suing over claims a doctor who purchased the office has failed to make payments.

Jonathon B. Murphy M.D. Inc. filed a lawsuit Oct. 16 in Kanawha Circuit Court against Dr. Rudolph M. Kevak Jr., citing breach of contract.

According to the complaint, the plaintiff and defendant entered into a security agreement May 2, 2011, wherein the defendant would purchase the medical office of Jonathon B. Murphy M.D. Inc. for $65,000. The plaintiff says the defendant was late with the $2,000 monthly payments from June 2011 to December 2011, and has failed to pay since. The plaintiff says the defendant is in breach of contract with an outstanding balance of $36,000.

The plaintiff seeks the amount owed, plus interest, costs and attorney fees.

It is represented by attorney Larry G. Kopelman in Charleston. The case has been assigned to Circuit Judge Tod J. Kaufman.
