State seeks injunction against Wirt. Co paper over workers' comp

CHARLESTON -- The state insurance commissioner is suing for an injunction to prevent a publishing company from operating until valid workers' compensation insurance is obtained.

The state of West Virginia, ex rel., West Virginia insurance commissioner, filed a lawsuit Nov. 5 in Kanawha Circuit Court against Little Kanawha Publishing Co. Inc., and James E. McGoldrick, in his individual capacity and in his capacity as president of Little Kanawha Publishing.

Little Kanawha Publishing publishes the Wirt County Journal.

According to the complaint, since the West Virginia workers' compensation system had been privatized, employers are required to obtain their insurance from private carriers, and the plaintiff is statutorily empowered to monitor such laws.

The complaint states Little Kanawha Publishing Co. and McGoldrick, its officer, have failed to obtain or maintain workers compensation insurance or has defaulted in payments, resulting in the defendants being placed on the plaintiff's private market default list and subject to fines and penalties, including an injunction preventing them from operating in West Virginia until out of default.

The plaintiff seeks the accumulated fine of $1,142 and an injunction preventing the defendant from operating until the penalties are satisfied and valid coverage is obtained. It is represented by attorney David Ansell of Charleston.
