Man blames I-77 dump truck incident for daughter's death

CHARLESTON – A Kanawha County man is suing over claims his daughter was fatally injured when a dump truck stopped on Interstate Highway 77.

Paul Neal Hardman, administrator of the estate of Amanda Gale Zornes, deceased, filed a lawsuit Oct. 30 in Kanawha Circuit Court against Mr Asphalt Inc. of Charleston, citing wrongful death.

According to the complaint, Zornes was on I-77 North on Oct. 23, when a dump truck towing a trailer hauling a streamroller and a front end loader malfunctioned or stopped in the middle of the highway, near the Westmoreland Drive exit, impeding traffic. The complaint states that the dangerous condition on the roadway led to the Zornes sustaining fatal injuries.

The defendant, who owned the dump truck, is accused of negligence and gross negligence.

Hardman seeks compensatory, punitive, general and special damages plus interest, attorney fees and costs.

He is represented by attorney Carl J. Roncaglione Jr. of Charleston. The case has been assigned to Circuit Judge Carrie L. Webster.
