CHARLESTON – A Kanawha County man is suing over claims his employer failed to pay him commission he earned.
Andrew T. Boyd filed a lawsuit Nov. 3 in Kanawha Circuit Court against THF Management Inc., citing the Wage Payment and Collection Act.
According to the complaint, Boyd was employed by the defendant as an asset manager, which earned him a $135,000 base salary plus commission for each project on which he had development responsibilities. Boyd says he earned more than $50,600 in development fees that have not been paid, including fees for the developments of Sam's Club at THF Silver Spring Commons, Buffalo Wild Wings and Chick-Fil-A development at THF York Mall, Buffalo Wild Wings at Hempfield Plaza and Wheeling/Highlands development.
The defendant is accused of violating the West Virginia Wage Payment and Collection Act.
Boyd seeks more than $202,600 in liquidated damages, unpaid compensation and attorney fees.
He is represented by attorneys Thomas M. Butz and Kendra L. Smith. The case has been assigned to Circuit Judge Charles E. King Jr.
