PINEVILLE – A Wyoming County man is suing over claims he was injured while working at a mine.

James D. Phillips filed a lawsuit Nov. 12 in Wyoming Circuit Court against Brooks Run South Mining, formerly known as Brooks Run Mining Company, Alpha Natural Resources Inc., and Stacy's Plumbing & Electric Company, citing negligence.

According to the complaint, Phillips was working as a salesman and route driver for Electric Laboratories Inc. on Nov. 13, 2012, when he tripped and fell on negligently constructed stairs at the defendants' Wyoming No. 2 mine. Phillips says he sustained injuries to his right hand, face and knees.

The complaint states defendant Stacy's negligently installed the stairs and deck as to leave a ledge at the top of the stairs, creating a tripping hazard. Phillips says others had previously tripped and reported the dangerous condition to the defendants and they failed to correct it. The defendants are accused of negligence.

Phillips is represented by attorney Adam Douglas Taylor of Beckley. The case has been assigned to Circuit Judge Warren R. McGraw.
