MADISON – A Raleigh County woman is suing a charter bus company for alleged failure to provide transportation services pursuant to the contract.
Alice Rider filed a lawsuit Dec. 2 in Boone Circuit Court against Cav's Coach Company, Chris Cavender and Walter Cavender.
According to the complaint, on July 8, Rider contracted with Cav's Coach Company to provide charter services for a group trip to New York City. The contract stipulated Cav's Coach would pick up the group in Boone County Sept. 19, the suit states, and the group would spend Sept. 20 in New York City and return to Boone County on Sept. 21. Pursuant to the contract, the total cost of the trip was $3,900, the suit states, and Rider submitted a $500 deposit to Cav's Coach on July 23, and the remaining $3,400 on Sept. 4.
The suit states the bus departed Boone County Sept. 19 and on Sept. 20 the bus became disabled. Cav's Coach then refused to transport Rider to New York City or make arrangements for an alternative means of transportation, according to the complaint.
Rider argues she suffered economic loss due to Cav's Coach Company's breach of the contract.
Rider seeks compensatory damages plus punitive damages, interest and fees.
