BECKLEY – A Fayette County couple is suing Wal-Mart Stores Inc. after the wife allegedly suffered a fall in the retail store.
Debra Hall and her husband, Rocky Hall, filed suit filed Dec. 11 in Raleigh Circuit Court against Walmart, citing negligence.
According to the complaint, on Dec. 26, 2012, Debra Hall was in Wal-Mart Supercenter store No. 1351, in Raleigh County and was walking through the store with a grocery cart, when she stepped on a foreign substance on the floor. The substance was similar to the consistency of play dough, or chewing gum, and had been on the floor for a long period of time, the suit states. Debra Hall’s boot became stuck in the substance, and she was unable to get the substance off the heel of her boot, according to the suit. Due to the substance being stuck on her boot, Debra Hall began to fall as she clung to the cart, which was sliding away from her, the suit states.
As a result of the fall, the plaintiff says she suffered injuries to her shoulder, arm, neck, back, head and arm. The injuries resulted from the defendant failing to properly maintain the surface of their store, the suit states. Due to the injuries, Debra Hall says she has suffered medical expenses, pain, loss wages, inconvenience and lost wages. Rocky Hall alleges he has lost the security of consortium with his wife.
The plaintiffs seek damages up to $75,000 for injuries and damages. The plaintiff are represented by attorney Jamison Conrad of Fayetteville. Circuit Judge Robert Burnside Jr. has jurisdiction on the case.
