Woman says state fired after seeking medical leave

CHARLESTON – A woman is suing a state department over claims she was fired after requesting medical leave.

Erin Shannon Roark filed a lawsuit Dec. 2 in Kanawha Circuit Court against the West Virginia Department of Agriculture.

According to the complaint, Roark was working as an accountant/auditor for the department when her physician informed her she needed to undergo a colonoscopy. Roark says she requested three days of medical leave in July 2014 for the procedure, and her supervisor questioned her about the condition before firing her June 9, 2014. The defendant is accused of violating the human rights act in failing to accommodate Roark's perceived disability.

Roark is represented by attorneys Larry O. Ford of Meyer, Ford, Glasser & Radman in Charleston, and Todd S. Bailess of Bailess Law Firm in Charleston. The case has been assigned to Circuit Judge Carrie L. Webster.
