Man blames hospital, doctor for wife's death

HUNTINGTON – A man is suing Cabell Huntington Hospital and a physician for the death of his wife.


The physician/patient relationship between Dr. Linda Savory and Lydia Harris was established on March 16, 2012 and continued until Harris' death, according to a complaint filed Dec. 29 in Cabell Circuit Court.


Robert Harris, Lydia Harris' husband, claims Savory and Cabell Huntington Hospital deviated from the acceptable standard of care and caused Lydia Harris' death.


As a direct and natural consequence of the acts and failures of the defendants, Lydia Harris experienced pain and suffering; discomfort; loss of enjoyment of life; and extreme duress before her demise, according to the suit.


Robert Harris claims his wife was caused to suffer a wrongful death on Dec. 27, 2012, due to the defendants' negligence  and medical malpractice.


The defendants' actions caused Robert Harris to suffer a loss of support from the reasonably expected earning capacity of the decedent; loss of services of the decedent; loss of society of the decedent, including loss of companionship, consortium, care, assistance, attention, protection, advice, counsel, instruction, training and education; loss of prospective inheritance to the decedent's heirs; and mental anguish, according to the suit.


Robert Harris is seeking compensatory and punitive damages. He is being represented by Michael A. Davenport of Lambert Law Office.


The case is assigned to Circuit Judge F. Jane Hustead.
