CHARLESTON – A Kanawha County man is suing over claims he was injured when his car hit ice allegedly caused by a main water line break.
Kevin Radcliffe and Shelby Radcliffe filed a lawsuit Dec. 16 in Kanawha Circuit Court against the West Virginia American Water Company, citing negligence.
According to the complaint, Kevin Radcliffe was driving in the Lance Drive area of Charleston on Jan. 7, 2013, when his car hit ice, spun out of control, crossed the median and turned on its side, trapping Radcliffe and causing severe injuries. The complaint states the ice was caused by the defendant's main water line in the area breaking, causing water to pour onto the street and freeze. Shelby Radcliffe is suing for loss of consortium.
The Radcliffes are represented by attorney Michael J. Del Giudice of Ciccarello, Del Giudice and LaFon in Charleston. The case has been assigned to Circuit Judge Joanna Tabit.
