CHARLESTON – A West Virginia woman is suing over claims a tree removal service cut down a tree in her back yard without permission.

Betty Tinsley filed a lawsuit Dec. 11 in Kanawha Circuit Court against Clark's Tree Service, citing trespass and common law negligence.

According to the complaint, the defendant entered Tinsley's property without her permission on June 18, 2014, and cut down a large shade tree in the back yard. Tinsley says she does not know why the defendant cut down the tree, which is estimated to be worth $7,000.

Tinsley seeks the cost of stump removal, cooling costs in the summer and other damages. She is represented by attorney Benjamin Sheridan of Klein, Sheridan and Glazer in Hurricane.
