Nine miners say they weren't paid wages in timely manner

CHARLESTON – Nine Kanawha County miners are suing over claims they were not paid final wages in a timely manner after being terminated.

David Doyle Jr., David Doyle Sr., Jimmy Fleshman, James Foster, Paul Martin, Herman Pickens, James Sawyers, Timothy Sheppard and Leroy Meadows filed a class-action lawsuit Nov. 21, 2014, in Kanawha Circuit Court against Remington, doing business as Winchester Mine, and Patriot Coal Services.

According to the complaint, the defendant terminated miners, including the plaintiffs, at its Winchester Mine on Nov. 1, 2014, but failed to pay them wages due in a timely fashion, constituting a violation of the West Virginia Wage Payment and Collection Act.

The plaintiffs are represented by attorneys J. Michael Ranson and Cynthia M. Ranson of Ranson Law Offices in Charleston, and G. Patrick Jacobs of Jacobs Law Office in Charleston. The case has been assigned to Circuit Judge Jennifer Bailey Walker.
