Coal Mountain couple sues mine for property damage

PINEVILLE – A Coal Mountain couple sued a mining company over claims the company destroyed their property.

Carl Curtis Harper and Patty Jean Harper filed a lawsuit Jan. 2 in Wyoming Circuit Court against Pay Car Mining Inc., Frontier Coal Company and Dynamic Energy Inc.

According to the complaint, the defendant conducted surface mining operations immediately adjacent to plaintiffs' property at HCR 67, Box 25, Coal Mountain, from 2007 until 2013.

The defendants negligently allowed mine refuse, giant boulders, sludge and runoff to destroy the value of their property, the suit states, and also failed to abide by West Virginia laws and regulations regarding mining operations.

The Harpers sustained losses to their property in the amount of $81,280.80, the suit states.

They seek damages of $81,280.80, along with punitive damages of $250,000. The Harpers are represented by attorney David G. Thompson of Thompson Law Office in Pineviile.
