Woman says city wrongfully fired her while on medical leave

CHARLESTON – A Kanawha County woman is suing over claims she was fired while out on approved medical leave.

Sharon Wiley filed a lawsuit Nov. 19, 2014, in Kanawha Circuit Court against the City of South Charleston, Frank A. Mullens Jr., mayor, and Gerald Burgy, director of public works.

According to the complaint, Wiley requested leave from her job with the defendants April 23, 2013, due to a medical condition and began her leave May 13, 2013. Wiley says when she returned to work in September, she found the defendant had terminated her employment July 26, 2013, to set an example to other employees who might request leave.

Wiley seeks damages, liquidated damages and attorney fees. She is represented by attorney Brian R. Blickenstaff of Turner & Johns in Charleston. The case has been assigned to Circuit Judge Joanna Tabit.
