WHEELING – A lawsuit against Williams Ohio Valley Midstream has been dismissed from federal court.
The plaintiffs, Richard F. Vargo and Jade L. Goodnight, and Williams Ohio Valley Midstream settled all claims involved in the lawsuit and moved to jointly dismiss the lawsuit from the court, according to a stipulated order of dismissal filed Oct. 2 in the U.S. District Court for the Northern District of West Virginia.
The lawsuit was originally filed on April 21.
Vargo and Goodnight claimed the defendant trespassed on their property.
The plaintiffs claimed the defendants attempted to enter into an agreement with them for the use of their property in order to access an adjoining landowners’ property in order to repair a pipeline located on it.
The plaintiffs refused the offer of $100,000 from the defendant, but despite their refusal the defendant is intentionally trespassing on the plaintiffs’ property, according to the suit.
The plaintiffs were seeking a declaration to forbid Williams from entering their property, damages, interest and any other relief they were entitled to. They were being represented by Daniel J. Guida of Guida Law Offices and Jonathan E. Turak of Gold, Khourey and Turak LC.
The defendant was represented by Sharon L. Potter, Christina S. Terek and Michael G. Connelly of Spilman Thomas & Battle PLLC.
The case was assigned to District Judge John Preston Bailey.
