Man claims McDonald's didn't fix slippery floor

FAYETTEVILLE – A man is suing a McDonalds restaurant in Smithers over claims he fell on a slippery section of the floor.

Phillip Wilson filed a lawsuit Jan. 22 in Fayette Circuit Court against McDonald's Restaurant of West Virginia Inc.

According to the complaint, Jan. 25, 2013, Wilson fell on a slippery tile on the floor near the cash register area of the McDonald's along U.S. 60. McDonald's was aware of the slippery floor and negligently failed to repair or replace the tiles, the suit states, and knew of the danger and failed to warn customers of the hazard.

Wilson alleges he sustained severe injuries due to the fall.

He seeks damages for all injuries suffered, along with lost wages, future earnings, interest and costs. Wilson is represented by attorney S. Brooks West II of the West Law Firm in South Charleston.
