Man trips on sidewalk, sues city and water company

FAYETTEVILLE – A man is suing a water company and the City of Oak Hill for allegedly failing to properly maintain a section of sidewalk.

Dale L. O'Daniels filed a lawsuit Jan. 21 in Fayette Circuit Court against West Virginia-American Water Company and the City of Oak Hill.

According to the complaint, on Nov. 4, 2013, O'Daniels was walking along the sidewalk near 220 Martin Ave. when he tripped on a sunken utility cover and unsafe section of the sidewalk and fell to the ground. The defendants negligently failed to repair and secure the section of the sidewalk, the suit states, and knew or should have known of the danger and failed to inform the public of the hazard.

O'Daniels says he suffered permanent injuries due to the fall.

He is represented by attorney Kevin B. Burgess of Hamilton, Burgess, Young & Pollard in Fayetteville.
