Woman blames business, others for dog's death

HUNTINGTON – A woman is suing Rodney's Heating & Cooling, two employees and the driver of a motor vehicle for the death of her dog.


In Fall 2005, Rodney Moore, who is doing business as Rodney's Heating & Cooling Services, installed a furnace and air conditioning system in the home of Pamela G. Newlon, according to a complaint filed Jan. 27 in Cabell Circuit Court.


Newlon claims periodically, Moore would send agents or employees to her home for service to the heating and air conditioning system.


On May 28, Richie Mills and an unknown employee came to inspect the system and Newlon advised them that her dog, Walter, was in the back yard and to not open the gate or he would run out of the yard, according to the suit.


Newlon claims the defendants negligently inspected the system  and informed her that they would need to order a coil for the system.


On June 5, the defendant returned to the home while Newlon was not there and entered the backyard without securing Walter, who they knew or should have known would leave the yard, according to the suit.


Newlon claims Jennifer Londeree, while operating her vehicle, saw Walter running free and operated her car in a reckless way and ran over the dog, ultimately resulting in his death.


Newlon sustained $882.06 in veterinary expenses and $116.57 in other expenses because of the defendants' negligence.


Newlon is seeking compensatory damages in the amount of $1,417.33 and punitive damages. She is being represented by Mchael Paesani.


The case is assigned to Circuit Judge F. Jane Hustead.
