BECKLEY – A woman has sued a retail store for damages allegedly caused by poor safety measures.

Sandra Mae Ewing (now Compton) filed a lawsuit Feb. 6 in Raleigh Circuit Court against Family Dollar Stores of Beckley W.V. Inc. alleging negligence leading to personal injury.

According to the filing, Ewing fell in the Lester Square store in Sophia on Feb. 16, 2013, while walking nearby a steel platform cart left on the floor. Store patrons and employees could not see the cart when approaching due to its position at the end of an aisle, the suit states, and Family Dollar Store was negligent in not removing the cart or warning people of its presence, purportedly creating a hazard.

Ewing suffered bodily injuries, mental distress, loss of enjoyment of life and related conditions.

Ewing seeks: compensation and punitive damages for medical expenses, pain and suffering; attorney fees; and costs. She is represented by attorney Anthony J. Sparacino Jr. of Beckley.
