Woman says she tripped on concrete at Kroger

BECKLEY – A Beaver resident has sued a retail company and its landlord for personal injury.

Rebecca Ann Martin filed a lawsuit Feb. 4 against The Kroger Co. and Kroger Limited Partnership I of Cincinnati, and BP Beckley, of Scottsdale, Ariz., in Raleigh Circuit Court, alleging negligence.

According to the complaint, Martin was shopping at the Kroger grocery store, at 151 North Beaver Lane in Beaver, on property owned by BP. Martin tripped on a broken portion of concrete located under a metal post used to support an awning and fell, the suit states.

According to the suit, the defendants were negligent in their duty to keep a safe environment and allowed hazardous conditions to exist. The suit states the defendants were fully aware of the safety hazard and failed to correct it.

Martin seeks compensatory damages for medical bills, pain, suffering, disability and related issues, plus attorney fees and costs. She is represented by attorneys Robert Campbell, Brian Bigelow and Jennifer Dempsey Meeteer, of Farmer, Cline & Campbell in Beckley.
