Couple says truck they bought was a lemon

PRINCETON – A Raleigh County couple has sued an automotive dealer and two financial firms, alleging violation of consumer law in a vehicle purchase agreement.

Daniel Price and Lisa Price filed a lawsuit Feb. 12 in Mercer Circuit Court against: Ramey Motors Inc., care of James C. Ramey Sr.; Ally Financial Inc., doing business as Ally Financial and GMAC; and Central Credit Services, alleging breach of contract.

According to the complaint, the Prices inquired of Ramey Motors about buying a reliable used truck June 11, 2013, and upon the sales manager’s recommendation, they drafted a purchase agreement for a 2010 Chevrolet Colorado LT. Daniel Price heard grinding noises in the engine while driving the next day, the suit states, and he brought the vehicle in for service, continued to experience problems, returned the vehicle twice more over several weeks and finally requested a refund.

When the Prices stopped making monthly payments, Ally and Central Credit began collection proceedings, the suit states, and both firms were verbally abusive, even after being asked to work with their attorney.

The plaintiffs allege breaches of warranty, good faith and fair dealing, invasion of privacy, negligence and emotional distress.

The Prices seek a rescission of contract and punitive damages, plus attorney fees and costs. They are represented by attorney Eric Buckner of Katz, Kantor, Stonestreet & Buckner, Bluefield. The case has been assigned to Circuit Judge Derek Swope.
