HUNTINGTON – A man is suing Delta Chi after he suffered injuries from an attack when he accompanied a friend to one of the Marshall University fraternity's parties.
Delta Chi Alumni Board of Trustees/Housing Corporation; Brandon Alexander; and John Does 1-5 were also named as defendants in the suit.
On Feb. 2, 2013, Delta Chi had a social event at its fraternity house and served alcohol to its members and guests, including Alexander, according to a complaint filed Feb. 2 in Cabell Circuit Court.
Brandon Adkins claims Alexander was severely intoxicated and had an unpleasant verbal altercation with Vincent Marks.
Adkins claims he had accompanied Marks to the fraternity house a little before midnight, but that he had not attended the party that evening.
Alexander walked out of the house with a baseball bat, which he concealed behind his back, and hit Adkins in the face with the bat, then hit Marks with the bat, according to the suit.
Adkins claims when he was hit, he was not even looking at Alexander and had not made any aggressive move toward him, nor had he spoke to him prior to the attack.
The plaintiff suffered significant injuries as a result of the attack and that the Huntington Police Department responded to the scene, conducted an investigation and subsequently filed criminal charges against Alexander for malicious wounding, according to the suit.
Adkins claims Alexander committed battery upon him and caused him to suffer damages for medical expenses; pain and suffering; and permanent impairment.
The defendants were negligent and caused Adkins' injuries, according to the suit.
Adkins is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Raymond Nolan and by Timothy P. Rosinsky of Rosinsky Law Office.
The case is assigned to Circuit Judge Christopher D. Chiles.
