CHARLESTON – A woman claims Charleston Area Medical Center was negligent in timely diagnosing her son and causing his death.
On Jan. 11, 2013, at approximately 9:23 a.m., Thomas Allen was seen in the emergency room at CAMC by Dr. Edward Wright and he complained of sore throat, congestion and post-nasal drainage, according to a complaint filed Jan. 8 in Kanawha Circuit Court.
Allen was discharged shortly thereafter and returned at 3:38 p.m. complaining that he could not swallow and an x-ray of the throat showed an throat abscess or edema, however, time was allowed to lapse and intubation was attempted and failed at 5:37 p.m.
An emergent cricothyroidotomy was also attempted and failed and Allen was pronounced dead at 6:25 p.m., according to the suit.
Evelyn J. Allen, the mother of Thomas Allen, claims the defendant negligently willfully and wantonly or with reckless disregard of risk of harm caused the death of Thomas Allen.
The defendant failed to timely diagnosed and treat Thomas Allen's condition and was otherwise negligent, according to the suit.
Evelyn Allen claims the defendant deviated from the appropriate standard of care, which resulted in the death of Thomas Allen.
Evelyn Allen is seeking compensatory and punitive damages with pre- and post-judgment interest. She is represented by Richard D. Lindsay and Dr. Richard D. Lindsay of Tabor Lindsay & Associates.
The case is assigned to Circuit Judge Louis Bloom.
