LOGAN – A Logan County resident has filed suit against his former employer for alleged negligence occurring in a July 2013 accident.
Teddy T. White of McConnell brought a lawsuit against CSX Transportation Inc. last month in the Logan Circuit Court, under the Federal Employers Liability Act (FELA), claiming failure to provide a safe working environment.
White was employed as a crew member for CSX, a common carrier of interstate and intrastate commerce. According to court documents, he sustained injuries to his back and neck on or about July 12, 2013, due to a sudden emergency stop by the train’s locomotive engineer.
Claiming that the train was operating at an unsafe speed, White seeks damages for physical pain and mental anguish, medical expenses, loss of earning capacity and other benefits, plus attorney fees and costs.
He is represented in the case by Willard Moody and Michael Davis of the Moody Law Firm of Portsmouth, Va. The case has been assigned to Judge O’Briant.
