Couple sues drug store after wife's fall at store

CLAY – A Clay County couple has sued a pharmacy chain for alleged personal injuries.

Judy Legg and Ford Henson Legg of Clay filed a lawsuit Jan. 27 in Clay Circuit Court against Rite Aid of West Virginia Inc., alleging negligence.

According to the complaint, on Jan. 28, 2013, Judy Legg was on the premises of Rite Aid Pharmacy in Clay when she tripped on gravel and debris near the curb of the parking lot, fell and was injured.

The suit states Rite Aid should have maintained a safe and orderly environment for its patrons and has a responsibility to keep the grounds hazard-free, The complaint says Judy Legg suffered an injury to her right leg along with pain and suffering, loss of enjoyment of life, and loss of consortium and services for her husband.

The Leggs seek damages for medical expenses, plus attorney fees and costs.

They are represented by attorney David Dawson of John R. Mitchell LC in Charleston. The case has been assigned to Circuit Court Judge Jack Alsop.
