WHEELING – A couple is suing Wheeling Hospital Inc. for injuries a man sustained while at its facility.
On Oct. 3, 2012, Samuel Judson Rogers was admitted to Wheeling Hospital for the diagnosis and treatment of complaints of heart-related problems, according to a complaint filed Feb. 3 in Ohio Circuit Court.
Rogers claims on Oct. 8, 2012, while he was unattended, he fell in his hospital room and hit his head on the floor. A c-scan of his head was performed, which revealed an accumulation of fluid on the brain known as hydrocephalous.
Because of the accumulation of fluid, Rogers developed progressive symptoms, including weakness, confusion and urinary incontinence and, over a period of time, his symptoms progressed and required medical and surgical treatment, nursing care, surgical insertion of a permanent brain shunt, surgical revision of the shunt and treatment of complications developed, according to the suit.
Rogers continues to require monitoring and intervention for the permanent shunt and other medical problems associated with the hydrocephalous and the treatment.
Rogers claims the defendants deviated from the applicable standard of care by failing to implement proper fall precautions and provide the attendant nursing care.
Rogers' wife, Judith Ann Rogers, suffered a loss of services of her spouse and consortium because of Samuel Rogers' injuries, according to the suit.
The Rogerses are seeking damages with pre- and post-judgment interest. They are being represented by C. Richard Wilson of Wilson Law Offices; and Kathleen J. Fantazzi of Gold, Khourey & Turak LC.
The case is assigned to Circuit Judge Martin J. Gaughan.
